1. Introduction

Welcome to kmfreelancers. These Terms and Conditions govern your access to and use of our website and services.
By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Platform.

2. Definitions

• “Freelancer” means an independent professional offering services through the Platform.
   
• “Employer” means an individual or entity seeking to hire Freelancers through the Platform.
   
• “User” means any person or entity using the Platform, including both Freelancers and Employers.
   
• “Project” means any work agreed upon between an Employer and a Freelancer through the Platform.
   

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts. By using the Platform, you represent and warrant that you meet these requirements.

4. Account Registration

Users must create an account to access certain features of the Platform. You agree to:

• Provide accurate, complete, and update informations
   
• Maintain the confidentiality of your login credentials and
   
• Be responsible for all activities under your account.
   

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Use of the Platform

You agree to use the Platform only for lawful purposes. You may not:

• Post false, misleading, or fraudulent information
   
• Use the Platform for illegal or unauthorized activities
   
• Interfere with the security or operation of the Platform
   
• Attempt to collect data about other users without consent.
   

6. Relationship Between Freelancers and Employers

The Platform acts solely as an intermediary connecting Freelancers and Employers.

• Freelancers are independent contractors, not employees or agents of kmFreelancers
   
• Employers are solely responsible for evaluating, selecting, and managing Freelancers.
   
• kmFreelancers is not a party to any contract between Freelancers and Employers and assumes no liability for any disputes.
   

7. Payments

Payments between Employers and Freelancers may be facilitated through the Platform or through third-party payment providers.

• Employers agree to pay Freelancers for completed work as per the agreed terms.
   
• Freelancers agree to deliver services according to the project scope and deadlines.
   
• kmFreelancers may charge service or transaction fees, which will be clearly disclosed before payment.
   

8. Disputes Between Users

Any disputes arising between Freelancers and Employers must be resolved directly between the parties.
kmFreelancers may, at its sole discretion, assist in mediating disputes but is not obligated to do so.

9. Intellectual Property

Users retain ownership of their own content but grant kmFreelancers a non-exclusive, worldwide, royalty-free license to display, host, and distribute such content for the purpose of operating the Platform.

You agree not to use any trademarks, logos, or proprietary materials of kmFreelancers without prior written consent.

10. Confidentiality

Users must keep confidential any non-public information obtained through the Platform or during Projects, unless disclosure is required by law or consented to by the other party.

11. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data in compliance with applicable laws, including the GDPR (if applicable).

12. Limitation of Liability

To the maximum extent permitted by law, kmFreelancers shall not be liable for:

• Any indirect, incidental, or consequential damages
   
• Loss of profits, data, or reputation
   
• Any disputes, delays, or issues between Freelancers and Employers.
   

The Platform is provided “as is” without any warranties, express or implied.

13. Termination

We may suspend or terminate your account or access to the Platform at any time if you violate these Terms or engage in fraudulent or harmful activities. You may close your account at any time by contacting our support team.

14. Changes to the Terms

We reserve the right to update or modify these Terms at any time. Updated Terms will be posted on the Platform, and continued use after such changes constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.
